Terms & Conditions for the “Seed the Day Flavor Submission” sweepstakes
OFFICIAL SWEEPSTAKES RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Void where prohibited or restricted by law or regulation. The “Seed the Flavor Submission” (the “Sweepstakes”) is open only to legal residents of the 50 (fifty) United States and the District of Columbia. Sweepstakes begins on August 23, 2008 at 12:01 a.m. (E.S.T.) and ends on December 31, 2008 at 11:59 p.m. (E.S.T).
Limit one entry per person, per email address, per household. If multiple entries are received by a single entrant, only the first entry will be considered and all subsequent entries will be disqualified. Go online to www.dagobaseedtheday.com and submit a flavor to enter to win.
All online entries will be considered to be submitted by the authorized account holder of the email address at time of entry. For the purposes of this Sweepstakes, the authorized account holder is the individual who has been assigned the email address by the online/service provider. The Winners may be required to provide Artisan Confections Company with proof that the Winners are the authorized account holder of the email address associated with the winning entry.
All Flavor submissions will become the property of Artisan Confections Company and winners will waive any right to inspect or approve the finished product as well as any royalties or other compensation arising from or related to the use of the flavor submission.
Sponsor is in no way responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received or sent by Sponsor, on account of technical problems or traffic congestion on the Internet or at any Web site or by human error which may occur in the ability of the participant to submit an entry, or any combination thereof, or otherwise, including any injury or damage to participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Sweepstakes. Persons found tampering with or abusing any aspect of this Sweepstakes, as solely determined by Sponsor, will be disqualified. If disqualified for any of the above abuses, Sponsor reserves the right to terminate participant’s eligibility to participate in this and/or future Sponsor sweepstakes and promotions. In the event any portion this Internet Sweepstakes is compromised by virus, bugs, non-authorized human intervention, fraud, technical failure or other causes beyond the control of Sponsor which, in the sole opinion of Sponsor, corrupts, or impairs the administration, security, fairness, integrity or proper entries in the Sweepstakes, Sponsor reserves the right, in its sole discretion, to cancel, modify, suspend or terminate this Sweepstakes, and reserves the right, in its sole discretion, to select Winners from eligible entries received prior to and/or after appropriate action has been taken by Sponsor. Sponsor is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorized access to, or alteration, of entries.
Five (5) Winners will be randomly selected from all valid entries on or about January 1, 2009. Each of the Five Winners will receive twelve bars of Dagoba Organic Chocolate each month for the twelve months in the 2009 calendar year.
The Winners will be notified by email on or about January 7, 2009 and the Winners will be required to confirm Winners’ mailing addresses to receive the prize via the U.S. Postal System or other package delivery service and required to complete, sign, and return a letter of award, including a prize Affidavit of Eligibility, Release of Liability and, if legally permissible, a Publicity Release within fourteen (14) days of prize notification. If Winners cannot be contacted within five (5) calendar days of first notification attempt, if any prize or prize notification is returned as undeliverable, or in the event of noncompliance with these Sweepstakes rules and requirements, such prize will be forfeited and an alternate winner will be selected from all remaining eligible entries. No compensation will be given for disqualification. There are no prize substitutions or transfers or cash redemptions. In the case of unavailability of any prize, Sponsor reserves the right to substitute a prize of equal or greater value. The Winners are solely responsible for all federal, state, and local taxes and any other unspecified expenses. Entry into Sweepstakes automatically constitutes permission of participant to use participant’s name and/or likeness of participant for advertising and promotional purposes without compensation, and without further notice, unless prohibited by law.
Odds of winning depend on number of eligible entries received from participants. Employees of Artisan Confections Company and its affiliates, subsidiaries, participating sponsors and their immediate family members and/or those living in the same household are ineligible. All federal, state, and local laws apply.
Void where prohibited. By accepting the prize, Winners agree to hold Sponsor, and its parent, subsidiaries, affiliates, and advertising/promotion agencies, and each of their directors, officers, employees and agents, from any and all liability for any injuries, including personal injury, death, loss or damage of any kind arising from participating in or in connection with acceptance, possession, use and or misuse of prize including participation and/or traveling to any prize-related activities and attendance at the prize event, and/or any claims based on right of publicity/right of privacy/defamation. Sponsor is not responsible if any portion of the prize cannot be awarded due to cancellations, delays, or interruptions due to Acts of God, War, natural disasters, or weather.
By participating in this Sweepstakes, entrants agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, which are final in all matters.
The name of the Sweepstakes Winners will be available by sending a self-addressed stamped envelope within 30 days of December 12th to: Seed the Day Flavor Contest, 914 Heinz Avenue, Berkeley, CA 94710.
